ACCOMMODATION AGREEMENT
Article 1 (Scope of Application)
- 1.The accommodation contracts and related agreements concluded between the accommodation and the guest shall be based on the provisions of these terms and conditions. Matters not stipulated in these terms and conditions shall be governed by laws and regulations or generally established customs.
- 2.If the accommodation accepts special provisions to the extent that they do not violate laws and regulations and customs, those special provisions shall take precedence over the provisions of the preceding paragraph.
Article 2 (Application for Accommodation Contract)
- 1.Those who wish to apply for an accommodation contract with the
accommodation shall provide the following information:
- (1)Guest's name
- (2)Date of stay and estimated time of arrival
- (3)Accommodation fee (in principle, based on the basic accommodation fee in Annex 1)
- (4)Other matters deemed necessary by the accommodation
- 2.If a guest requests to extend their stay beyond the date specified in item 2 of the preceding paragraph, the accommodation will treat it as a new application for an accommodation contract at the time the request is made.
Article 3 (Formation of Accommodation Contract)
An accommodation contract is formed when the accommodation accepts the application from the preceding article. However, this does not apply if the accommodation proves that it did not accept the application.
Article 4 (Refusal to Conclude Accommodation Contract)
The accommodation may not accept the conclusion of an accommodation contract in the following cases. However, this article does not mean that the accommodation may refuse accommodation in cases other than those listed in Article 5 of the Ryokan Business Act.
- 1.When the application for accommodation does not comply with these terms and conditions.
- 2.When the rooms are full and there is no vacancy.
- 3.When the person seeking accommodation is deemed likely to engage in acts that violate the provisions of laws and regulations, public order, or good morals in connection with the accommodation.
- 4.When the person seeking accommodation is deemed to fall under
any of the following categories:
- a. An organized crime group (boryokudan), an organized crime group member (boryokudan-in), a quasi-member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
- b. A corporation or other organization whose business activities are controlled by an organized crime group or an organized crime group member.
- c. A corporation whose officers include a person who falls under the category of an organized crime group member.
- 5.When the person seeking accommodation has engaged in speech or behavior that causes significant nuisance to other guests.
- 6.When the person seeking accommodation is a patient with a specified infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Ryokan Business Act.
- 7.When a violent demand is made in connection with the accommodation, or an unreasonable burden is requested (excluding cases where the person seeking accommodation requests the removal of social barriers as stipulated in Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities).
- 8.When the person seeking accommodation repeatedly makes demands to the accommodation that are stipulated in Article 5-6 of the Ryokan Business Act Enforcement Regulations, as demands whose implementation places an excessive burden on the accommodation and is likely to significantly hinder the provision of services related to accommodation to other guests.
- 9.When accommodation cannot be provided due to a natural disaster, facility malfunction, or other unavoidable circumstances.
- 10.When the case falls under the provisions of the prefectural ordinance.
Article 5 (Guest's Right to Cancel the Contract)
- 1.The guest may cancel the accommodation contract by notifying the accommodation.
- 2.If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest, the accommodation will charge a penalty fee as specified in Annex 2.
- 3.If the guest does not arrive by 10:00 PM on the day of the stay without contacting the accommodation, the accommodation may treat the accommodation contract as having been canceled by the guest. (In that case, a penalty fee will be charged as specified in Annex 2) .
Article 6 (Accommodation's Right to Cancel the Contract)
- 1.The accommodation may cancel the accommodation contract in the
following cases:
- (1)When the guest is deemed likely to engage in acts that violate the provisions of laws and regulations, public order, or good morals in connection with the accommodation, or is deemed to have committed such acts.
- (2)When the guest is deemed to fall under any of the following categories:
- a. An organized crime group, an organized crime group member, a quasi-member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
- b. A corporation or other organization whose business activities are controlled by an organized crime group or an organized crime group member.
- c. A corporation whose officers include a person who falls under the category of an organized crime group member.
- (3)When the guest has engaged in speech or behavior that causes significant nuisance to other guests.
- (4)When the guest is clearly recognized as having an infectious disease.
- (5)When a violent demand is made in connection with the accommodation, or an unreasonable burden is requested (excluding cases where the guest requests the removal of social barriers as stipulated in Article 7, Paragraph 2 or Article 8, Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities1).
- (6)When the guest repeatedly makes demands to the accommodation that are stipulated in Article 5-6 of the Ryokan Business Act Enforcement Regulations, as demands whose implementation places an excessive burden on the accommodation and is likely to significantly hinder the provision of services related to accommodation to other guests.
- (7)When accommodation cannot be provided due to unavoidable circumstances such as a natural disaster.
- (8)When the case falls under the provisions of the prefectural ordinance.
- (9)When the guest does not comply with the prohibitions in the usage rules set by the accommodation, such as smoking in bed in the bedroom, tampering with fire-fighting equipment, etc. (limited to those necessary for fire prevention).
- (10)When the guest smokes in a designated non-smoking area, tampers with fire-fighting equipment, or performs an act that hinders fire prevention.
- (11)When the guest brings or attempts to bring any of the following items into
the accommodation:
- a. A gun without a license.
- b. Swords without a license.
- c. Items that emit a strong offensive odor.
- d. A significantly large quantity of items.
- e. Items that are easily flammable or combustible (e.g., fireworks, sparklers, gunpowder, gasoline).
- f. Animals, insects, or similar items (for guide dogs, please consult with the accommodation in advance when applying for the accommodation contract).
- (12)When the guest takes out or moves the accommodation's fixtures or items to another location within the accommodation.
- (13)When the guest attempts to change, remodel, or alter the building or facilities.
- (14)When the guest does not comply with the prohibitions in the usage rules set by the accommodation.
- 2.When the accommodation cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for the accommodation services, etc., that have not yet been provided. (In that case, a penalty fee will be charged as specified in Annex 2) .
Article 7 (Registration for Accommodation)
- 1.On the day of use, the guest shall register the following information in the
accommodation's check-in system:
- (1)Guest's name, address, age, contact information (phone number), and gender.
- (2)For foreign guests (who do not have an address in Japan), nationality and passport number (presentation of passport).
- (3)Other matters deemed necessary by the accommodation.
- 2.If the guest is a minor, they cannot stay alone.
Article 8 (Room Usage Hours)
The guest can use the accommodation's rooms from 4:00 PM until 10:00 AM the next morning. However, for consecutive stays, the room can be used all day, except for the day of arrival and departure. The accommodation may allow the use of the room outside the hours specified in the preceding paragraph. In this case, the following additional charges will apply:
- (1)For up to 2 hours of overtime, 20% of the accommodation fee.
- (2)For more than 2 hours of overtime, the equivalent of one night's accommodation fee.
Article 9 (Compliance with Usage Rules)
Guests are required to comply with the usage rules established and posted by the accommodation within the premises.
Article 10 (Business Hours)
- 1.The accommodation's check-in hours are as posted on each reservation website.
- 2.The accommodation is, in principle, open all year round. If there are closures or changes in hours, a notice will be posted on each reservation website.
- 3.Emergency contact information is listed in the house manual located within the facility.
Article 11 (Payment of Fees)
- 1.The breakdown of accommodation fees, etc., to be paid by the guest is as listed in Annex 1.
- 2.The payment of the accommodation fees, etc., mentioned in the preceding paragraph shall be made at the time of reservation in Japanese yen, with coupons approved by each reservation website, with a credit card, or with electronic money or an equivalent method.
- 3.Even if the guest voluntarily does not stay after the accommodation has provided the room and it has become available for use, the accommodation fee will be charged.
Article 12 (Accommodation's Responsibility)
The accommodation will compensate the guest for damages caused during the performance of the accommodation contract and related agreements or due to non-performance thereof. However, this does not apply if the damage is not due to reasons attributable to the accommodation.
Article 13 (Handling When Contracted Room Cannot Be Provided)
- 1.If the accommodation cannot provide the guest with the contracted room, the accommodation will, with the guest's consent, arrange for another accommodation facility with conditions as similar as possible.
- 2.Notwithstanding the provisions of the preceding paragraph, if the accommodation cannot arrange for another accommodation facility, it will pay the guest a compensation fee equivalent to the penalty fee listed in Annex 2, and that compensation fee will be applied to the amount of damages. However, if the inability to provide the room is not due to reasons attributable to the accommodation, no compensation fee will be paid.
Article 14 (Handling of Deposited Items)
The accommodation cannot take custody of the guest's belongings, cash, or valuables.
Article 15 (Storage of Guest's Baggage or Personal Belongings)
If the guest's baggage or personal belongings are left behind at the accommodation after check-out and the owner is identified, the accommodation will contact the owner and ask for instructions. However, if there are no instructions from the owner or if the owner cannot be identified, the accommodation will handle the items as follows:
- 1.Valuables (cash of 100,000 yen or more and other items specified in the Lost Property Act Enforcement Order): The items will be submitted to the nearest police station within 7 days, including the day of discovery.
- 2.Items other than valuables: The items will be handled in accordance with the Lost Property Act and other related laws and regulations.
Article 16 (Responsibility for Parking)
The parking lot can be used for up to two vehicles per room. When a guest uses the accommodation's parking lot, the accommodation is only lending the space and does not assume responsibility for the management of the vehicle. However, if damage is caused during the management of the parking lot due to the accommodation's intent or negligence, the accommodation will be liable for compensation.
Article 17 (Guest's Responsibility)
If the accommodation suffers damage due to the guest's intent or negligence, the guest shall compensate the accommodation for that damage.
Article 18 (Use of Internet Communication)
When using the internet communication within the accommodation through the Wi-Fi service or other communication methods provided by the accommodation, the guest shall do so at their own risk. Furthermore, if the accommodation determines that a guest's use of internet communication is inappropriate and damage is expected to be caused to the accommodation or a third party, the accommodation may request the guest to stop the internet communication, and the guest will be charged for the amount of damages incurred by the accommodation.
Article 19 (Stipulations on Room Cleaning)
If a guest stays in the same room for consecutive nights, daily cleaning will not be performed. If a guest stays for four or more consecutive nights, cleaning will only be done on a day specified by the guest after the second night. However, cleaning will be performed at a maximum frequency of once every three days, and if a different arrangement is set at the time of reservation, that arrangement will apply. If no day is specified by the guest, cleaning will be performed at the minimum intervals deemed necessary for the maintenance and hygiene of the room, in consideration of the purpose of laws and prefectural ordinances. During the period when cleaning is not requested, towels, linens, and amenities will not be replaced or replenished. The guest cannot refuse the accommodation's judgment regarding the minimum frequency of cleaning necessary for the maintenance and hygiene of the room.
Article 20 (Miscellaneous)
- 1.If a guest has a problem, accident, or other dispute with another guest due to reasons not attributable to the accommodation, the guest shall resolve it themselves.
- 2.If the accommodation deems it necessary for its business operations, it may change the contents of these terms and conditions. In this case, the accommodation will provide information at an appropriate time and in an appropriate manner, in light of the impact and the status of service operations.
- 3.These terms and conditions shall be interpreted in accordance with Japanese law. If a lawsuit becomes necessary regarding these terms and conditions, the Tokyo District Court shall be the court of exclusive jurisdiction in the first instance.
- 4.These terms and conditions are prepared in Japanese and a foreign language designated by the accommodation. If there is any inconsistency or difference between these terms and conditions and the translated foreign language version, the Japanese version of these terms and conditions shall take precedence.
Annex 1: Breakdown of Accommodation Fees, etc.
The total amount to be paid by the guest is broken down as follows:
- Accommodation Fee
- Basic accommodation fee
- Additional Charges
- Additional food and drinks (excluding those included in the accommodation fee)
- Early check-in/late check-out
- Taxes
- Consumption tax
- Hotel tax/hot spring tax (only in hot spring areas)
Remarks
- The basic accommodation fee is based on the prices presented on each reservation website.
- Guests who are elementary school students or older are considered adults.
Annex 2: Penalty Fees
The penalty fee varies depending on the date of notification of contract cancellation:

Note
- If a cancellation policy is set on a reservation website, that cancellation policy will apply.
- The percentage is the ratio of the penalty fee to the basic accommodation fee.
- Shortening the reservation period will be treated as a cancellation of the entire itinerary, and a penalty fee will be calculated based on the above cancellation policy.
